Terms and conditions
1. General provisions
1.1. These rules of sale and purchase (hereinafter referred to as the "Rules") are a binding legal document between the parties, which establishes the rights, obligations, conditions of purchase and payment of the goods, the procedure for delivery and return of the goods, the liability of the parties, and other provisions related to the purchase and sale of goods.
1.2. The Seller has the right to change, amend or supplement the Rules at any time, taking into account the statutory requirements. Any amendment to the Rules applies only to orders placed after the amendment to the Rules.
1.3. The use of the services of "www.nidore.lt" is available to natural persons of legal capacity; minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, unless they are independently disposing of their income; legal persons and authorised representatives of the persons mentioned above.
1.4. The online shop www.nidore.lt is selling not only in the territory of the Republic of Lithuania, but also throughout Europe
2. Guarantee of security of personal data
2.1. The online shop "www.nidore.lt" has the right to collect and process the personal data provided by the Customer and to provide them to third parties when necessary for the execution of the order. The online shop "www.nidore.lt" may use the personal data of the Buyer for advertising and providing information to the Buyer.
2.2. The Buyer may prohibit the collection and processing of his/her personal data for marketing purposes (sending news, promotions by email or mobile phone) by informing "www.nidore.lt" by the email address "firstname.lastname@example.org", except where this is necessary for the fulfilment of the requirements arising from the Sales and purchase agreement or for the execution of an Order.
2.3. The data of the Customers and visitors of the online shop are protected against loss, unauthorised use, alteration and against third parties.
3. Concluding the sale and purchase agreement
3.1 The agreement between the Buyer and the Seller is deemed to be concluded from the moment when the Buyer, having selected the product(s) to be purchased and having formed a shopping cart, clicks on the "Confirm order" button in the order form.
4. The Buyer's rights
4.1. The Buyer has the right to purchase goods in the "www.nidore.lt" online shop in accordance with these Rules and the online shop.
4.2. The Buyer has a right to withdraw from the Sale and purchase agreement with the Seller by notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) within 7 (seven) working days from the date of delivery.
4.3. The Buyer may exercise this right only if the goods have not been damaged or substantially altered in appearance or used. The Buyer's right, provided for in clause 4.2. shall be exercised in accordance with the Order of the Minister of Economy of the Republic of Lithuania No. 258 of 17 August 2001 "On the approval of the rules for the sale of goods and provision of services when contracts are concluded by means of communication".
5. The Buyer's obligations
5.1. The Buyer must accept the goods ordered and pay the price of the goods and delivery (if any).
5.2. If there is any change to the details provided by the Buyer on the registration form, the Buyer must update them immediately.
5.3. The Buyer undertakes not to pass on his login details to any third party. If the Buyer loses his/her login data, he/she must immediately inform the Seller by means of contact indicated in the "Contact" section.
5.4. The Buyer, when using the "www.nidore.lt" online shop, undertakes to comply with these Rules and not to violate the legislation of the Republic of Lithuania.
6. The Seller's rights
6.1. If the Buyer attempts to interfere with the operation, security or stable functioning of the online shop, the Seller shall have the right to restrict or terminate the Buyer's access to the online shop or, in exceptional cases, to cancel the Buyer's registration, without prior notice.
6.2. In exceptional circumstances, the Seller may temporarily or permanently suspend the operation of the online shop without prior notice to the Buyer.
6.3. The Seller has the right to cancel the Buyer's order without prior notice to the Buyer if the Buyer fails to pay for the goods within 5 (five) working days.
6.4. www.nidore.lt has the right not to conclude a Purchase and sale agreement with a particular Buyer who has refused the Purchase and sale agreement and has returned the goods 2 or more times in the last 12 months.
6.5. The online store "www.nidore.lt" has the right to cancel the concluded Purchase and sale agreement if the stocks of the goods specified in the agreement are out of stock, as well as if the agreement has been concluded by a person who, according to the present Rules, had no right to conclude it.
7. The Seller's obligations
7.1. The Seller undertakes to deliver the Goods ordered by the Buyer to the address specified by the Buyer, on the terms and conditions and within the delivery times set out in these Rules.
7.2. In the event of serious circumstances where the Seller is unable to deliver the goods ordered to the Buyer, the Seller undertakes to offer the Buyer an equivalent product and, if the Buyer refuses to accept an identical product, to refund the money paid by the Buyer (if the goods have been paid for) within 5 (five) working days.
8. Prices, payment procedures and terms
8.1. The prices of the Goods in the online shop and in the order form shall be quoted in euros including VAT. The online shop "www.nidore.lt" reserves the right to change the prices of the goods in the event of changes in tax rates.
8.2. The Buyer pays for the Goods by bank transfer, either by printing out the order in advance and going to a bank branch, or by using online banking services.
9. Delivery of goods
9.1. The Seller or its authorised representative delivers the Goods.
9.2. The Seller undertakes to deliver the Goods to the Buyer in accordance with the time limits specified in the descriptions of the Goods. These time limits do not apply in the event that the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. The Buyer agrees that in exceptional cases the delivery of the Goods may be delayed due to Force Majeure circumstances.
9.3. The Goods are delivered to the address specified by the Buyer.
9.4. The Buyer undertakes to accept the Goods personally. If the Buyer is unable to accept the goods himself and the goods have been delivered to the address indicated on the basis of other data provided by the Buyer, the Buyer has no right to claim that the goods have been delivered to the wrong entity.
9.5. When collecting the goods from the shop, the Buyer is obliged to inspect the condition of the goods, the quantity, quality and range of the goods together with the Seller or his authorised representative. Once the Buyer has signed the invoice (bill of lading) or any other document of Transfer and acceptance of goods, the goods shall be deemed to have been transferred in good condition.
9.6. In the case of courier services, couriers are not responsible for the condition of the goods but only for the delivery of the goods.
9.7. If the Buyer cancels the Sale and purchase agreement in accordance with these Rules, the Buyer undertakes to pay all direct costs of returning the goods to the Seller. The amount of such costs incurred by the Seller will be deducted from the monies paid by the Buyer for the goods to be returned.
10. Returns and exchanges of goods
10.1. Returns and exchanges of goods shall be carried out in accordance with the "Rules for Returns and Exchanges of Goods" approved by Order No 217 of the Minister of Economy of 29 June 2001 and the "Rules for the sale of goods and the provision of services in the case of contracts concluded by means of communication" approved by Order No 258 of the Minister of Economy of 17 August 2001.
10.2. The Buyer may exercise the right to return and exchange the goods within 7 (seven) working days from the date of delivery of the goods to him by informing the Seller in accordance with the procedure provided for in clause 4.2 of the Rules.
10.3. The returned goods must be in their original packaging, unused, undamaged by the Buyer, and must not have lost their merchantable appearance (labels intact, protective films not torn, packaging not torn, etc.). The returned goods must be in the same condition as when received by the Buyer. When returning the product, the document of purchase and the warranty card (if issued) must be presented.
10.4. Goods which the Buyer wishes to return may be delivered in person or sent by courier. Goods will be accepted at any of our offices, the addresses of which can be found in the "Stores" section. If the goods are returned in accordance with the right provided for in clause 4.2, the Buyer shall bear the cost of returning the goods. In the case of returns of the wrong goods and/or goods of poor quality, the Seller undertakes to take back such goods and replace them with similar, suitable goods. If the Seller does not have analogous goods, the Seller shall refund the money paid for the goods to the Buyer.
10.5. The Seller has the right not to accept the Buyer's return of the goods if the Buyer does not comply with the return procedure set out in these Rules.
11.1. The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer accepts liability for the consequences arising from any inaccuracy or incorrectness of the data provided in the registration form.
11.2. The Buyer is obliged to protect his/her login data and not to disclose it, to ensure that the data is known and used only by him/her, and not to transfer or otherwise make the data available to other persons. All actions performed using the Buyer's identification data are deemed to have been performed by the Buyer and the Buyer accepts full responsibility for the consequences of such actions.
11.3. The Seller is exempt from any liability in cases where the loss is caused by the Buyer's failure to read these Rules, despite the Seller's advice and obligations, despite being given the opportunity to do so.
11.4. The Seller is not responsible for the information provided on other companies' websites, even if the Buyer accesses these websites via links on the Seller's online shop.
12. Exchange of information
12.1. The Seller sends all notifications to the email address provided by the Buyer in the registration form.
12.2. The Buyer sends all notifications and questions to the addresses indicated in the "Contact" section of the Seller's online shop.
13. Final provisions
13.1. The law of the Republic of Lithuania shall apply to the relations arising based on these rules.
13.2 . All disagreements arising out of or in connection with the Purchase and sale agreement between the Buyer and the Seller are settled by negotiation. In the event of failure to reach an agreement, disagreements are settled in accordance with the procedure established by the legislation of the Republic of Lithuania.
